Welcome to Greywater Software! Our mission is to provide powerful, easy-to-use software for everyone. Most of our tools are free and open source, while some premium features are paid. We rely on donations and affiliate partnerships to continue development.

This document explains, in plain language, how you may use our software, what your rights are, and how we handle any personal information you provide. Think of this as both a Terms of Service and a Data Privacy Guide, merged into one comprehensive agreement.

By installing, accessing, or using any Greywater Software product or service (collectively “Services”), you agree to these terms. If you do not agree, please do not use our Services.

1. How This Agreement Works

This Agreement has two main purposes:

  1. To explain your rights and responsibilities as a user of Greywater Software.
  2. To describe how we process, store, and protect personal data.

We want this document to be clear and readable, so we provide examples and explanations where appropriate. While written for consumers, it is fully legally enforceable worldwide, compliant with laws such as GDPR, CCPA/CPRA, LGPD, PIPEDA, Australia’s Privacy Act, and other applicable regulations.


2. Using Our Services

When you use our Services, you receive a license, which means you are allowed to use the software, but Greywater Software retains ownership.

2.1 What You Can Do

  • Install and run our software on your devices for personal or business use.
  • Receive free updates and improvements.
  • Access community support, documentation, and tutorials.
  • Make donations to support development.

2.2 What You Cannot Do

  • Copy, distribute, sell, or sublicense the software without explicit permission.
  • Attempt to reverse-engineer, decompile, or bypass security mechanisms.
  • Use the software for illegal or harmful purposes.

Example: If you download a free tool to clean up your system, you can install and use it on your personal computer. You cannot, however, republish it as your own software or sell it to others.


3. Payments, Donations, and Premium Features

Some of our software features require payment. Any payments made are generally final unless required by law. Donations are voluntary contributions to support the development of free software; donating does not grant additional rights or guaranteed access to premium content unless specified. Payment processing is handled securely by trusted third-party services. Greywater Software does not store complete payment card information.

Example: If you buy a premium feature, the fee covers your access and any updates included during the period of use. If you make a donation, we use it to improve free software for all users.


4. Data Collection and Privacy

Your privacy is extremely important. Here’s how we handle your personal information:

4.1 Types of Data Collected

We may collect data you provide directly, data collected automatically, and data from third-party integrations.

  • Direct Data: Name, email, account info, and support messages.
  • Automatic Data: Device type, operating system, IP address, and usage statistics.
  • Third-Party Data: Data from donations, affiliate links, or software integrations you use.

We do not knowingly collect information from children under the age allowed by law in your jurisdiction.

Example: When you sign up for an account, we store your email to send updates. If the software crashes, we collect error logs to help fix issues.

4.2 How Data Is Used

Your data helps us:

  • Provide and maintain the software.
  • Improve software performance and security.
  • Respond to your support requests.
  • Process payments or donations.
  • Comply with legal obligations.
  • Communicate updates if you opt in.

Example: If you contact support about a bug, your email and usage details may be used to diagnose the problem and respond efficiently.


5. Data Processing Agreement (DPA)

When you provide personal data, Greywater Software acts as a data processor. You, as the user, determine the purpose of the data, and we process it on your behalf.

5.1 Our Responsibilities

We are legally required to:

  • Only process your data for the purposes necessary to provide the Services.
  • Keep your data secure using encryption, access controls, and monitoring.
  • Ensure personnel who access data are bound by confidentiality.
  • Notify you promptly if a breach occurs.
  • Delete or return your data upon request, unless legally required to retain it.

5.2 Sub-Processors

Some data processing may be done by trusted third-party providers. These Sub-Processors are contractually bound to protect your data.

5.3 International Transfers

Personal data may be stored or processed outside your country. Transfers are made only under recognized legal frameworks such as GDPR Standard Contractual Clauses, UK IDTA, or other approved mechanisms.

5.4 Your Rights

Depending on where you live, you may have rights including:

  • Access, correction, and deletion of your data.
  • Objection to certain types of processing.
  • Data portability (download your data).
  • Opt-out of sale or sharing of personal data.

6. Security Measures

We use advanced security techniques, including encryption, access management, backups, and incident monitoring. While no system is completely invulnerable, we strive to protect your information to the highest standard.

Example: Data you provide when reporting a bug is stored securely and cannot be accessed by unauthorized parties.


7. Liability

Our software is provided “as is.” Greywater Software is not responsible for indirect, incidental, or consequential damages, such as lost profits, lost data, or business interruption. Our maximum liability is the greater of the amount you paid for the software in the past twelve months or $50 USD. Mandatory consumer rights in your jurisdiction are not affected.


8. Consumer Rights

We respect all legal consumer protections. Depending on your location, these may include:

  • The right to cancel purchases within a set period.
  • The right to access and delete personal data.
  • Statutory guarantees that cannot be waived.

We comply with all such protections.


9. Termination

We may suspend or terminate access for violations of this Agreement, misuse of the software, or illegal activities. You must uninstall and remove all copies of the software upon termination. Certain clauses, including confidentiality, liability, and data protection, remain in effect after termination.


10. Governing Law and Dispute Resolution

This Agreement is governed by the laws of [Insert Jurisdiction]. Disputes may be resolved through arbitration or local courts, subject to mandatory consumer protections.


11. Updates

We may update this Agreement to reflect changes in services, law, or best practices. Updates are posted at https://greyws.com. Continued use after updates constitutes acceptance.

Annex I – Personal Data Processing

Retention: Data is retained only as long as necessary for services or legal obligations.

Data Subjects: Users, customers, supporters, employees, partners.

Data Types: Name, email, IP address, identifiers, support requests, payment info (partial/hashed), usage stats.

Processing Activities: Storage, analysis, troubleshooting, support, reporting.
